ArbDossier ICAR is a peer-reviewed blog containing analytical articles written by practitioners and academics all across the globe. With a diligent editorial board and an advisory board consisting of some of the biggest names in arbitration, each article on the ArbDossier ICAR blog must pass several stages of review before it is deemed worthy of publication.
An initiative that endeavours to contribute to the global arbitration community through data-based studies and analysis.
The data collected from primary research is to enable informed decision making for stakeholders vis-à-vis arbitration and national courts.

57% of all applications filed for the appointment of an arbitrator before the Bombay High Court were disposed within 2 months from the date of filing! Additionally, 38% of applications were disposed with a month from the date of filing and 18% of applications were disposed within just two weeks from the date of filing!

A preference for lawyers…
In 105 total arbitrator appointments made by the Bombay High Court, a staggering 81% of all arbitrators appointed were Advocates practicing in High Courts!

A likely chance...
Out of a 143 applications for arbitrator appointments filed before the Bombay High Court, it was found that there was a 70% chance that the application would succeed! Further, it is pertinent to note that in almost 10% of cases, the application was either withdrawn by the parties or consent terms were agreed upon.

In an overwhelming majority of cases (95%), the Bombay High Court appointed a sole arbitrator, as opposed to a 3-member tribunal when faced with an application under Section 11 for arbitrator appointment.

Adapting to Complexity…
Out of all the Section 11 applications filed before the Bombay High Court, 31% pertained to multi-party disputes while 15% were related to multi-contract disputes. This is clearly indicative of the fact that arbitration has emerged method of resolution for complex disputes, as opposed to litigation before the court system.
